We are committed to workplace fairness for everyone who works. We are here to help employees at all stages of their employment, from hiring through separation.
Employee Discipline and Wrongful Termination
When an employee is facing discipline or termination, we help employees preserve their rights. We offer timely consultations and advise employees on how to advocate for themselves when they are facing discipline, investigation, or termination.
If an employee is terminated, we help employees exhaust their appeal rights and navigate the administrative and litigation process. This includes identifying possible claims; filing charges with administrative agencies, such as the CCRD, EEOC, and OSHA; filing wage complaints and demands; initiating litigation in state, federal, or administrative court; and litigating disputes through discovery, motions, and trial. We also advise employees on whether to consider mediation, mediation strategies, and other dispute resolution options.
Employment Contract Review
Employment agreements can arise before, during, and at the end of the employment relationship, and can have significant impacts on an employee’s rights to compensation, mobility, and ability to find future work. We review and advise employees on all manner of employment-related agreements, including:
- Compensation, commission, and bonus agreements
- Stock option agreements
- Offer letter acknowledgements
- Confidentiality, trade secret, proprietary information and intellectual property agreements
- Change in control agreements
- Separation and severance agreements
- Waivers and release of claims
Accommodations, Discrimination, and Retaliation
Employees are entitled to a workplace free of discrimination and retaliation. We advise and represent employees who:
- Are seeking disability, religious, pregnancy, and other accommodations at work
- Need help navigating how to use medical/sick leave, PTO, STD and LTD in their particular situations
- Have been retaliated against for engaging in protective activity, like whistleblowing, providing information as part of an investigation, filing a charge of discrimination, or complaining about discrimination or retaliation
- Need assistance filing complaints with administrative agencies like the CCRD, EEOC, OSHA, and others
Unpaid Wages and Compensation
Employees are entitled to be paid for the work they do. We regularly help employees who:
- Have not been paid according to their compensation, commission, or employment agreements
- Had improper deductions made from their pay
- Did not receive all the compensation they were owed after they separated from their job
- Were not properly paid PTO, vacation, or for other promised benefits
- Been retaliated against for complaining about unfair pay practices
